Terms of Service
Effective October 28, 2026 · Version 2026-10-28
This launch provides account registration, organization and team setup, and tray-list intake. Tray processing, clinical release decisions, invoicing, and card checkout are not active.
1. Agreement and operator
These Terms govern Cynch Trays, operated by CynchTrays, LLC (“Cynch Trays,” “we,” “us”). By accepting these Terms or using an account, you agree to them on your own behalf and, where applicable, on behalf of the organization you are authorized to represent. Contact us at support@cynchtrays.com or 11757 W. Ken Caryl Ave, F272, Littleton, CO 80127, United States.
2. Professional use and eligibility
The service is for professional business use by adults age 18 or older. You must have authority to submit your organization’s information and invite its users. We do not market to minors. We do not market to or intentionally target individuals in the European Union. This statement does not waive rights or obligations under applicable law.
3. Accounts and organization access
Provide accurate account information and keep your email account and sign-in links secure. Do not share sign-in links or sessions. Organization admins control membership and roles. Users may submit tray lists to their organization. Authorized Cynch Trays super admins can access organizations to administer and support the service. Notify us promptly of unauthorized access. Your organization is responsible for its authorized users and for checking their access.
4. Free registration and service scope
Registration and onboarding submissions are free. Free registration is not a promise of permanent free access to future paid features, a service-level commitment, or an agreement to process all submissions by a particular date. Features described as planned are not currently available. Product illustrations are examples, not live operational records.
5. Prices, orders, and payments
The published plan is $349.88 per month in USD. An annual plan paid in advance is $3,778.70 per year, a 10% discount from twelve monthly payments after rounding to cents, saving $419.86. Both include unlimited trays and users. Applicable taxes are additional. Purchase orders and credit cards are supported payment options for paid activation. This launch records preferences only; it does not collect card details, issue invoices, initiate a subscription, automatically renew an order, or charge you.
Any paid activation requires a separate accepted order specifying the start date, term, payment due dates, renewal arrangements, cancellation process, and refund terms. A PO alone does not activate service until accepted by us. We will disclose those terms before you commit. Do not send card numbers, security codes, or bank details through uploads, email, or support forms. Price changes apply prospectively with notice and do not change an accepted prepaid term unless agreed in writing.
6. Your content and permissions
You retain ownership of content you submit. You grant us a limited, nonexclusive permission to host, store, transmit, display to authorized users, and use that content to provide, secure, support, and improve the service for your organization. You represent that you have the necessary rights and permissions. You are responsible for accuracy, lawful submission, and keeping your own backups. We do not acquire ownership of your tray lists.
7. Prohibited data and acceptable use
Submit tray and instrument information only. Do not submit patient names, patient identifiers, case records, protected health information, health records, sensitive personal information, payment credentials, illegal material, malicious files, or information you lack authority to disclose. Do not attempt to access another organization’s data, bypass access controls, disrupt the service, or use it for unlawful activity. Unlimited trays and users do not permit abuse or infrastructure attacks. Technical file-size and upload-batch limits apply.
8. Sterilization and clinical responsibility
Cynch Trays is administrative software. It does not sterilize instruments, establish sterility, validate a sterilizer or reprocessing cycle, replace manufacturers’ instructions for use, or make clinical, infection-control, or tray-release decisions. Qualified personnel must independently follow applicable procedures, manufacturer instructions, and institutional requirements. Do not use this launch as your authoritative sterilization or release record. No FDA clearance, regulatory certification, HIPAA compliance certification, or clinical performance claim is made.
9. Privacy and essential sessions
Our Privacy Policy explains our handling of data. We use a necessary authentication cookie for signed-in sessions only. We do not use analytics or advertising cookies, track anonymous visitors, or enroll you in marketing by registering. See the service disclosures for current limitations.
10. Availability, suspension, and ending access
We may change features, perform maintenance, or suspend access reasonably needed to address misuse, legal obligations, or security risks. Where practical, we will provide notice and an opportunity to resolve an issue. You may stop using the service and request account closure or data export/deletion at support@cynchtrays.com. Paid-order obligations, if any, are governed by that order. Organization-managed data requests may require authorization from an organization admin. Do not rely on us as your only copy of operational records.
11. Warranties and liability
To the extent permitted by applicable law and except as expressly promised in a signed order, the service is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. We do not promise uninterrupted service or that a submitted list has been clinically reviewed. To the extent permitted by law, neither party is liable to the other for indirect, incidental, special, consequential, or punitive damages. Our aggregate liability arising from the service is limited to the greater of $100 or the fees you paid us for the service during the twelve months preceding the event giving rise to the claim. These limits do not apply where prohibited by law and do not exclude liability that cannot lawfully be excluded.
12. Governing law and disputes
Colorado law governs these Terms, excluding conflict-of-law rules, subject to nonwaivable applicable law. Unless mandatory law requires otherwise, disputes will be brought in state or federal courts with jurisdiction in Colorado. Please first contact support@cynchtrays.com so we can try to resolve a concern. These Terms do not impose mandatory arbitration or a class-action waiver.
13. Changes and general terms
We will post revised Terms with an updated effective date and provide notice of material changes when appropriate. Changes are prospective. If a provision is unenforceable, the remaining provisions continue to apply. A separately signed order controls conflicting commercial terms. No amendment waives mandatory rights under applicable law.
